THE PARTIES
don Quijote Uk In-Country Language Courses Ltd (hereinafter called “don Quijote”) whose registered office is at 2/4 Stoneleigh Park Road, Stoneleigh, Epsom, Surrey KT19 0QT organises and acts as agent for overseas bodies which offer and supply students and others with tuition and accommodation, for in-country language courses, and may arrange insurance for students. don Quijote as agent effects all bookings and reservations for students unless notified to the contrary, and it may, at is discretion, intercede, without charge on behalf of students who become in dispute with any persons or bodies in connection with any matters arising provided however that don Quijote shall not thereby be liable or become liable in any way in connection with any such matter nor does it vouch for the content or accuracy of any brochures or publicity documents prepared for students by any such persons or bodies and it is accepted that students' possible remedies shall be against such overseas bodies only.
“The student” means a person or persons who have signed the application form for such an in-country language course (or if under age a parent or person in loco parentis of such person or persons). Where a booking is made for more than one student the body or organisation making the booking will be regarded as the student for the purpose of this agreement. In consideration of the price agreed to be paid for its Principals' courses and accommodation as set out on the Registration Form the following terms and conditions shall apply as between the parties: General don Quijote accepts no responsibility whatsoever for cases of force majeure (according to law) or for students' actions.The don Quijote management reserves the right to accept students aged 17 in exceptional cases. On formalising enrolment on a course (and accommodation) over the internet, by fax, online booking or written enrolment form students accept the general and payment conditions and payment method as well as the norms, rules and guarantees of don Quijote that they have been previously given and read.

ARTICLE 1 - THIS AGREEMENT
This agreement is legally binding when the registration form is completed and signed by the student and accepted by don Quijote or if effected by telephone when the registration form has been completed by don Quijote with the insertion of the student's passport details AND after don Quijote have received the agreed advance payment.The specific written approval of don Quijote is required for any variation to this agreement.The Law of England shall apply to this agreement.

ARTICLE 2 - PAYMENT CONDITIONS
An advance payment of £85 is to be sent to don Quijote with a completed registration form for each student enrolling.The remaining balance must be received at the office of don Quijote no later than 2 weeks prior to the start date. In the event of default of payment by that time don Quijote shall be entitled to rescind this agreement in which circumstances the amount already paid is accepted by the student as being nonrefundable. don Quijote reserves the right to sue for the balance payable or the whole booking.Where a booking is made within 2 weeks prior to course start date the entire costs of the course and accommodation shall be paid at the time of registration and the total amount due for the course and accommodation must be received by don Quijote in time for funds to have been cleared the day before departure in which case payment may be needed by bank transfer or such other suitable means to achieve this at the expense of the student.Due to currency fluctuations prices may be subject to change.All bank charges will be your responsibility. In cases where the bank charges us a commission for receipt of your payment we reserve the right to charge you this sum on arrival. These prices are valid until December 31 2009 for courses beginning and ending in the year 2009.This price list over rules all previous information about prices and dates.don Quijote is not responsible for printing errors that may appear or for errors in publications by third parties about don Quijote.

ARTICLE 3 - INSURANCE
Civil Liability: don Quijote has an accident and civil liability insurance policy that covers possible incidents or minor accidents that may occur within its centres. don Quijote is not responsible for the loss or theft of students' personal property for which we recommend you take out your own insurance policy.

ARTICLE 4 - TRAVEL DOCUMENTS
Relevant travel documents may be arranged between a designated Travel Agent and the student or the student may make his/her own travel arrangements. Students themselves must arrange prior to departure all necessary travel documents in connection with their abroad i.e. valid passport, valid visa (if required), driver's license, green card. Any costs, damages or other charges arising from cancellation or curtailment due to a student's failure to comply with the above shall be the sole responsibility of the student.

ARTICLE 5 - LAST MINUTE RESERVATIONS AND CHANGES
For the confirmation of reservations made 2 weeks or less before arrival, the total amount must be paid in full at the time of enrolment.£95 will be charged for administrative costs for changes to your confirmed reservation after arrival.

ARTICLE 6 - CANCELLATIONS
Cancellations before arrival will only be accepted in writing (letter, e-mail or fax), cancellations made by telephone will not be deemed valid. For cancellation prior to the last two weeks before arrival there will be a loss of the advance payment of £85.For cancellation in the last two weeks before arrival there will be a penalisation of £385. For the Kids, Juniors & Teen Programmes the penalty will be £770.In no case whatsoever will money for the course/accommodation be refunded once the course has started (except in the case of the refund guarantee).In all reimbursements an administration fee of 10% of the amount to be refunded will be charged (a minimum of £45) to cover the costs of returning your money, as well as the standard fee for changes in the reservation (£95). Students who require any type of student visa for their course and have to cancel their course must send an official certified document directly from the Embassy. Under no circumstances will the money already paid be refunded regardless of whether the student has opted for the cancellation guarantee. For students who have visas, cancellations will only be considered once the student provides proof of leaving the country and once the visa obtained through don Quijote is no longer valid. In addition the cancellation will only be valid on the student's return to the country of origin.Refunds must be requested within 60 days following completion of the course. Once this period is complete the student no longer has the right to request any refund.Refunds will be made within 45 days following the request.In the event of a cancellation original prices will be applied whether or not the student has opted for a special discount or promotion. For example if on booking the course the student received a discount due to the length of the course this will be lost on cancellation.Refunds can only be made and money can only be transferred to the student who booked the course. Refunds will never be made to anyone other than the student or the tutor who paid for the reservation.

ARTICLE 7 - ALTERATIONS RESULTING FROM THE ACTIONS OF THIRD PARTIES
don Quijote does not accept any liability for changes in arrangements for transport, tuition, accommodation, insurance or any other matters where made by other parties and any legal rights of redress which a student may have must be solely directed to such other parties.

ARTICLE 8 – CUSTOMER SERVICEN
otwithstanding the provisions of this agreement excluding legal obligation or liability on its part nevertheless don Quijote will in the event of a complaint by a student against an overseas body in connection with its preferred course or associated accommodation, use its best endeavours to rectify the situation to the reasonable satisfaction of the student involved provided that such complaint was notified to the appropriate secretariat abroad as soon as reasonably practicable and the student has exhausted all other reasonable practicable solutions in the overseas country involved.Complaints, opinions, suggestions and/or requests made after the leaving date of the study and stay at don Quijote can only be of an informative nature, with a view to improving our level of service, and do not oblige don Quijote to refund monies, unless legally required to do so.

ARTICLE 9 - CANCELLATION GUARANTEE
We recommend our special cancellation guarantee if you are taking a course of longer than 2 weeks. The cost of this guarantee is 5% of the total sum of the invoice (nonrefundable) and has to be paid in full upon reservation in order to be valid.With this guarantee we will refund the cost of your course, accommodation and extras if you cancel your course at any time from the day of enrolment until the end of your course. Your guaranteed refund will NOT include the enrolment fee, the accommodation fee, the cost of 1 week services (course, lodging) and services already used at the time of cancellation, the cost of the guarantee itself, your travel costs and an administration fee of 10% of the amount to be refunded to cover the administrative costs of returning your money.For Premium Courses the refund process is slightly different and we will not penalise you with the cost of 1 week of services (course, lodging). If the accommodation reserved was a shared or private student flat the student is required to pay 100%.This guarantee is personal and nontransferable and will be applicable in the following cases: work, examination, proven illness by a Spanish doctor of the student following arrival in Spain, pregnancy or the obligation of doing military service.The time period covered by this guarantee is from the day of enrolment until the finalisation of the course and accommodation with don Quijote. For a full refund of this amount an official document verifying the reason for the cancellation will be required within 10 days of the cancellation. This document has to be sent by post or courier to the don Quijote UK booking office. You will also have to complete the form at www.idealeducationgroup.com/contactus
The refund will be made within 45 days.Not having obtained a visa is not an adequate reason for the cancellation guarantee to take effect.If you have enrolled for a course that is more than 5 weeks and you use the cancellation guarantee you should be aware that prices may change depending on how many weeks you will have eventually. For example, if you enrol for 12 weeks and you need to reduce your course to 4 weeks, the 4 week price will be applied.

ARTICLE 10 - MEDICAL INSURANCE
We advise all citizens of the EU to bring the E111 document. If you require medical treatment, with this document and the medical bill you will be able to reclaim the medical expenses back home.

ARTICLE 11 – CLASSES
In high season some classes may be given in classrooms outside of our installations.don Quijote's management reserves the right to extend the timetable for classes to 9 p. m.

ARTICLE 12 – ACCOMMODATION
The student will be charged for the replacement of broken items due to either negligence or by intention.If there is damage and no one is directly responsible, we will divide the cost of repairs among all the students in the flat or residence.In high season the flats and student residences may be substituted by another type of accommodation at corresponding price.In the case of a serious disciplinary offence or repeated bad behaviour the student will be expelled from the accommodation contracted with don Quijote without the right to any refund.

ARTICLE 13 – ADMISSION OR EXPULSION
don Quijote reserves the right to cancel the student's place if on the day of their arrival they have not paid the total sum of the course, accommodation and other services contracted.In the case of a serious disciplinary offence, repeated bad behaviour or infringement of the laws of the country in which the course is taking place, the student will be expelled from the school and accommodation contracted with don Quijote without the right to any refund.In the case where damages are caused to third parties, all the expenses claimed from don Quijote that originate from the above-mentioned incident will be charged to the student, who will have no right to later claims.

ARTICLE 14 – COPYRIGHT
The management of don Quijote reserves the right to use all possible photos taken during the student's stay unless the student declares otherwise on his arrival at the school.

ARTICLE 15-CONTRACT
No signatures are necessary for the agreement. Any bookings or payments confirm the acceptance of the agreement with all the conditions.

ARTICLE 16-HOLIDAYS

Please check our web site www.donquijote.org for updated holidays as they may be subject to change. don Quijote is not obliged to refund or make up any classes missed due to National and Local Holidays.

ARTICLE 17-DISCOUNTS AND CREDIT NOTES
The Enrolment Fee is valid for one year from the first reservation made for don Quijote schools. In other words any course reserved during this year can be made using the same enrolment fee. This is not applicable to the accommodation fee.Discounts cannot be accumulated and all of them have a set duration period. They cannot be used in conjunction with one another and are only applicable when students are eligible for them when enrolling. Discounts that become available after the first enrolment are not valid.Credit Notes are only valid for up to 12 months. Once this period of 12 months comes to an end the student loses the right to them.

PROTECTION OF PERSONAL DATA
In compliance with Spanish Law 15/1999 December 13, regarding the protection of personal data, don Quijote would like to inform you that your personal details within these general conditions will be stored in a database (whose liability and responsibility is dQ, S.L.) solely for the commercial and operative uses of the company. By accepting these general conditions you give your consent to the above said treatment and for their use for the aforementioned purposes. At the same time we inform you of your rights to access, correct and cancel such information within the established terms of the prevailing legislation in writing to the address at: Calle Placentinos 2, 37008 Salamanca, Spain.
